A green card category for investors and their families, based on a lawful investment and the jobs it creates in the United States.
EB-5 is a US immigrant category for investors. The investor, spouse and unmarried children under 21 may receive green cards by meeting requirements for invested capital, source of funds and job creation.
Main requirements
- Invested capital: under the EB-5 Act of 2022, the minimum is USD 1,050,000, or USD 800,000 in a targeted employment area (TEA). These amounts can be adjusted, so check again when filing.
- Job creation: the investment must create at least 10 full-time jobs for qualifying workers in the United States.
- Lawful source of funds: you must clearly show the origin and path of the money.
- Capital at risk: an EB-5 investment carries no guarantee of return of capital or profit.
Main steps
- Financial review: we review your source of funds and your family’s goals.
- Project due diligence: look closely at the project and at the regional center or direct investment model.
- File Form I-526 or I-526E: filed with USCIS with evidence of the investment and source of funds.
- Receive a conditional green card: processed through a consulate or by adjusting status in the United States, valid for 2 years.
- File Form I-829: show that the investment was sustained and job requirements were met in order to remove the conditions.

Does EB-5 guarantee return of capital?
No. The law requires the capital to be at risk, so you should carry out independent due diligence on the project before investing.
